Refund Policy
This Refund Policy governs the refund process for participation in the GoInvest Academy by Elena Azarenko practical investment program operated by AmericaTok Production LLC (the “Company”).
By paying for participation in the program, the User confirms that they have reviewed this Policy, understand its contents, and accept all of the terms set forth herein.
1. General Provisions
1.1. The practical investment program is a digital informational product provided electronically.
1.2. The Company provides the User with access to the program materials after successful payment has been confirmed.
1.3. Access is provided by sending a link to join the private Telegram channel or by another method determined by the Company.
1.4. This Policy is an integral part of the User Agreement (Public Offer).
1.5. By making payment, the User confirms their agreement with this Policy.
2. When the Service Is Considered Provided
2.1. The Company’s obligations are considered fulfilled from the moment the User is provided with access to the practical program.
2.2. Access is considered provided when the User is sent a link to the private Telegram channel or is provided with another method of receiving the materials.
2.3. The fact that the User does not use the access provided does not affect the moment when the Company’s obligations are considered fulfilled.
2.4. Failure to use the program materials, in whole or in part, is not grounds for a refund.
3. Refunds
3.1. Before access is provided, the User may request cancellation of participation and a refund.
3.2. After access to the practical program has been provided, refunds are not issued because the User receives access to a digital informational product that cannot be returned once provided.
3.3. Exceptions apply in cases where:
- the Company failed to provide access due to its own fault;
- the User was charged twice;
- funds were charged in error due to the fault of the Company or the payment system.
3.4. If such circumstances are confirmed, the Company will issue a full or partial refund.
4. Refunds Are Not Provided
Refunds are not issued if:
- the User changes their mind after receiving access;
- the User’s expectations do not match the content of the program;
- the User does not have enough time to study the materials;
- the User does not use the access provided;
- the User considers the program too difficult or too easy;
- the User does not achieve the expected financial result;
- the User incurs losses as a result of independently making investment decisions;
- the User violates the User Agreement;
- the Company terminates access due to a violation of the program rules.
5. Violation of the User Agreement
The Company may terminate access to the program without a refund if the User:
- shares the access link with third parties;
- distributes program materials;
- copies materials without permission;
- records the screen for the purpose of further distributing materials;
- uses materials for commercial purposes without the Company’s written permission;
- represents themselves as a representative of GoInvest Academy by Elena Azarenko;
- violates the communication rules in the private Telegram channel;
- takes actions that may cause harm to the Company, its business reputation, or other program participants.
6. How to Submit a Refund Request
6.1. If the User believes there are grounds for a refund, the User must submit a request by email using the address provided on the official website.
6.2. The request must include:
- first and last name;
- email address;
- payment date;
- payment amount;
- description of the circumstances;
- proof of payment, if available.
6.3. The Company may request additional information necessary to review the request.
7. Review of a Refund Request
7.1. The Company reviews the request after receiving all necessary information.
7.2. If the grounds for a refund are confirmed, the funds will be returned using the same payment method used for the original payment, where technically possible.
7.3. The time required for the funds to be credited depends on the bank, payment system, and other financial institutions and is outside the Company’s control.
7.4. The Company may deny a refund if there are no grounds for a refund under this Policy.
8. Bank and Payment System Fees
8.1. Fees charged by banks, payment systems, and other financial institutions in connection with payment or refund processing may be non-refundable if provided by the rules of the relevant organization.
8.2. The Company is not responsible for payment processing times established by banks and payment service providers.
9. Changes to the Refund Policy
9.1. The Company may change this Refund Policy at any time.
9.2. The new version of the Policy becomes effective upon publication on the official website unless another effective date is specified in the revised version.
9.3. Changes do not apply to payments made before the publication date of the revised Policy unless otherwise required by law or stated by the Company.
10. Payment Disputes (Chargebacks)
10.1. If the User initiates a payment dispute (chargeback) through a bank or payment system, the Company may provide documents confirming:
- the fact of payment;
- the fact that access to the practical program was provided;
- the User’s acceptance of the User Agreement;
- the User’s acceptance of this Refund Policy;
- the User’s acceptance of the Privacy Policy;
- the User’s acceptance of the Disclaimer.
10.2. Until the dispute is resolved, the Company may temporarily restrict the User’s access to the program materials.
10.3. If the payment system confirms that the Company properly fulfilled its obligations, the Company may protect its rights by all means available under applicable law.
11. Fraudulent Activity
11.1. The Company may refuse to provide access or terminate access to the program without a refund if there are signs of fraud.
11.2. Such cases include, but are not limited to:
- use of another person’s bank card without the cardholder’s consent;
- providing false information;
- attempts to gain access to the program unlawfully;
- abuse of the refund process;
- use of forged documents;
- other actions indicating bad-faith use of the website or program.
11.3. Where there are lawful grounds to do so, the Company may provide necessary information to payment systems, banks, or competent governmental authorities.
12. Force Majeure
12.1. The Company shall not be liable for inability to perform its obligations due to force majeure circumstances.
12.2. Such circumstances include:
- Internet outages;
- technical failures of Telegram;
- technical failures of payment services;
- power outages;
- natural disasters;
- epidemics;
- military actions;
- decisions of governmental authorities;
- changes in legislation;
- other circumstances beyond the Company’s control.
12.3. If such circumstances occur, the time for performance of the relevant obligations shall be extended for the duration of such circumstances.
13. Confirmation of Review and Acceptance
13.1. By paying for participation in the practical program, the User confirms that they:
- have carefully reviewed this Refund Policy;
- understand the contents of this Policy;
- accept all of its terms;
- understand that after access to the digital informational product has been provided, refunds are available only in the cases expressly provided for in this Policy.
13.2. The User also confirms that before making payment, they had the opportunity to review the description of the practical program, its content, price, and participation terms.
14. Final Provisions
14.1. This Policy applies together with:
- the User Agreement (Public Offer);
- the Privacy Policy;
- the Disclaimer.
14.2. If any provision of this Policy is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
14.3. This Policy shall be governed by the laws applicable to the activities of AmericaTok Production LLC, unless otherwise required by mandatory provisions of applicable law.
